A new federal court ruling says states can ban wine shipments from out-of-state retailers, even if they allow in-state retailers to ship directly to customers.
It's comes this week out of the Secord Circuit in New York, and the decision is just the most recent ruling, as the dispute makes its way through the federal court system.
It's contrary to federal court opinions out of Texas and Michigan. Last year, the law in Michigan was struck down as unconstitutional. The state law had banned direct shipping from out-of-state retailers, but allowed it for companies that have stores in Michigan.
Lawmakers responded to te court by changing that law and banning direct-consumer shipments from all retailers, whether from in-or-outside of the state.
The rulings do not affect wineries, which can ship to Michigan customers.
